What is Required for a Personal Injury Claim?
Find Out if You Have Grounds to File for Personal Injury
Not just anyone can file a claim for personal injury. In order to recover compensation for injuries that you sustained in an accident, you must first provide proof of physical injury and of liability. Without these two things, it is very unlikely that you will be able to recover any compensation.
Liability
You cannot file a claim for personal injury if you were responsible for your accident and/or injury, even in part. You will need to prove that one or more other parties were responsible for your accident.
Injury & Damages
You will also need to prove that your injuries and other damages were directly caused by the accident. If your injuries were the result of something unrelated to your accident, or if you cannot prove that they were caused by your accident, then you cannot recover compensation for them through a personal injury claim. Excellent evidence can include photos of your accident, injuries, and damages; witness statements; police reports; and doctors’ notes.
